When Samsung asks Japan for this discovery, Apple will cite Samsung's request
here disclosing that such requests are not, and should not be granted by
Japanese courts. Does this make it a knowingly frivolous request?

Of course Samsung can quote Apple to the Japanese as saying their request can be
granted.

What's a little side snit? More for the lawyers ... or how to dwindle a
billion.

Regarding the Update. I think, it's not selling or leasing.
If Steve Jobs gave his wife an iphone, that might be
interesting. Or if examples were passed to potential network
partners, which wouldn't be too surprising. Or if one was
lost, that might be interesting. Or if someone working in an
Apple store sold one to a friend. And it might not be too
surprising if a journalist got hold of one before the date,
but embargoed the coverage.
