"Are you you using the phrase 'win-win' in its usual meaning
of 'both parties stand to gain by the same action'?"

That is not the usual meaning.

"Maybe instead of calling it a 'win-win', a phrase that PJ
did not use, it would be clearer to say that it looks like
Samsung has a good shot at getting discovery whichever way
the Japanese court decides?"

So maybe instead of using "win-win", or "heads I win, tails
you lose", I should have instead paraphrased PJ's argument
to be that no matter what happens in the future, Samsung
will get discovery and, in effect, win the motion.
