Can you imagine MS or Apple raising the right hand and promising not to sue...
while crossing the hidden left hand's fingers of course :-)
To keep your fingers crossed secretly when you tell a lie absolves you from any responsibility for that lie. If your lie is discovered, you can claim to have had your fingers crossed at the time

It's like saying:

    I promise I won't defend myself unless someone attacks me first!
In a civilized society:
    Everyone has the right to defend
    No one has the right to attack
So the promise makes it clear that the patents won't be used aggresively unless the entity is attacked first.

Unlike Microsofts "promises", there's:

    No funny language that leaves you wondering if Microsoft even made a promise in the first place
    A list of the actual patents involved
