Yea! If they are so interested in being paid just for linking - then the proverbial book should be thrown at them.

In that case, skip the 80k per infringement. They should be held to the full 150k per infringing work. I certainly can't think of a more egregious situation then:

    I want to be paid if someone just links to my own site where my work is produced but I can out-right copy other's work!
Since it's the "worst case" I can think of - it's deserving of the "worst case" penalty.

Seems fair to me :)

AFP vs Google Lawsuit

For those who may not remember it, in that March 2010 lawsuit AFP was asking for
17.5 million dollars in damages for "copyright infringement over the
inclusion of AFP content in Google News".
