I am bothered by Apple's anti-competitive use of a design patent for something
that is frankly not that original. I am also bother by FRAND patents for a
slightly different reason.
Hi, I have designed this "thing", I have recommended that this thing
be incorporated into a standard, but I have to charge a licensing fee to anyone
who wants to inter operate with my design. Hope you don't mind. The problem
is that the thing is not innovative; it is just one way of solving a problem.
A company that does not choose to cooperate (using the standard) ends up with a
product that does not work with the rest of the world.
It just seems that patents, in both cases, are a means to keep competition out
