No problem. And you're right, it might well settle, primarily because either (a)
the plaintiffs realize there is not much left to their case, and what is left,
it seems the judge is itching to dismiss, and/or (b) the defendants do not want
their discovery disclosures to end up in a public summary judgment motion. It
might however go to summary judgment if both parties, cheered on by their
attorneys who are billing by the hour, convince their clients that have a great
case and should continue paying them.
