I think you missed the gist of that.

If the legislature wants to specifically exempt, say,
software from the patent system, then it should do so.

Just like Oregon (and other states like Florida) remove "the
right to exclude" from the bundle of rights property owners
have from beachfront property.

But that's a decision of the legislature.

As for Scotland, the people and sheep are welcome to roam
where they want to, subject to their own laws.
