Judge William Alsup v Judge Lucy Koh - Day v Night - Efficiency v Confusion - Order v Chaos.
Authored by: Anonymous on Friday, December 28 2012 @ 12:43 PM EST
From what I know, it seems at best premature to say Apple has won almost
entirely or to even praise Apple's tactics. No permanent injunction for Apple
so far, and the two preliminary injunctions Apple briefly did have were reversed
or vacated. It also looks like Judge Koh is going to throw out at least one of
the utility patents (which may require a retrial on some or maybe even a lot of
issues) and is going to at least reduce damages in other areas. Plus, as others
have said, there is the incalculable damage Apple has inflicted on itself with
its troll-like behavior. But whatever the ultimate outcome in the lawsuit, it
won't be based on the "just let me help you out judge" ingratiating
behavior Apple seems to have been laying on so thick with the judge in this
transcript.
