I noticed that line, too.

I can hardly wait to see how Apple 'splains this one away.

Personally, I think that Samsung should be just fine if the
EU sees the same things that I see. Perhaps the EU is just
dotting the i's and crossing the t's before going after the
real target - Apple. Didn't they start this patent circus in
the first place? Abusing SEPs can swing both ways, you know.

Let me highlight the keyword again:

    such conduct may be abusive
As a result any cheering by fans that FRAND patents can't be used defensively against a patent attack may be premature to the actual end result.

EU confirms their suspicion that Samsung *was* naughty

  1. The investigations have thus far been internal, and this Statement of Objections is formal notice to Samsung that the EC has found something they don't like, would Samsung Please Explain
  2. There has been expansion of this invitation to file a brief, into formal charges by many of the press.
  3. Even though Samsung has withdrawn its (applications for?) injunctions, this is not like a US case where the attorneys shake hands and go out for a drink together and the whole case is dropped. Once it gets on the books in Europe it stays on the books. Samsung could be punished, present or future good behaviour may not absolve past sins.
