The software patent experts' code (WARNING - MAY CONTAIN PATENT CLAIMS!).

great analysis but don't forget that it is a novel idea to use your fingers to
do something!
We learned hard to not eat with the fingers but use fork and knife and now we
are going back to eating finger-food again.
Who could have ever imagined (without Apple) that one could use fingers to do
something on a cellphone? Until a few years ago they did an excellent job
innovating and exploring new markets. Today they completely lost it.

At USPTO there is nothing obvious any more except their lack of qualification.
I hold a US (hardware) patent which was fully granted without any reduction in
claims. It failed miserable, completely rejected, at the European Patent Office
for an expired US patent I was not aware of (yes, a US patent!).
