that kind of open ended question
Which question
is that? I see two questions:
-
"In your expert opinion is this a
strong and defendable patent?"
- "...how much were you paid?"
The answer
to the first is clearly a "Yes" or "No"; the patent is either "strong and
defendable" or not - I see no request for the reason why it is strong and
defendable or not, which would be an open ended question. Should it have been
asked as "In your expert opinion, did you conclude that this is a strong and
defendable patent?" which is the intent behind the first question, but obviously
asked by SNAL (Someone Not A Lawyer], nor SNAP (Someone Not A Pedant). [IANAL,
IASAP {I Am Sometimes A Pedant}]
The answer to the second is a number which
may, or may not, be admissible - this could be construed as an open ended
question, but only in so far as there are many different numbers which could be
