Parent posits about how anti-software patent folk
can do some things like Hogan when on juries in
order to help defeat software patents.
Somehow I think open source software people are likely
to be more principled, and less likely to do such things.
But if open source software folk ever were Hoganish,
I would hope they would be smart enough to keep their
mouths shut about it afterwards.
I would also hope that by actually sticking to the
law and following jury instructions that they would
be able to convince fellow jurors of the invalidity
of software patents.
Looking at the bright side, in some respects we are
lucky that Hogan was so talkative. Had Hogan not
rushed the jury to sloppily fill out the verdict form,
and had Hogan not bragged about his role afterwards,
we might never have known how badly justice has
been subverted thus far.
This has also focused some public attention on Apple's
bad behaviour and raised some awareness of Android
alternatives to Apple for smartphones. This whole
debacle might be one of the worst things that Apple
has done for themselves yet.
While Judge Koh may not yet have seen fit to go for
another trial, without the over-the-top antics of
Hogan, the appeals court might not want to order
a new trial either. The more unreasonable Koh's
denials of Samsung's motions are, the better the
chance that Samsung might be helped by an appeal.[ Reply to This | Parent | # ]
