I don't understand her logic. I thought Hogan was presumptively biased
based entirely on his objective actions during voir dire. His motivations or
possible bad memory have nothing to do with it.
Despite the reams of evidence
to the contrary, suppose Hogan was unbiased. Suppose he left out the pertinent
bankruptcy case by accident and so on and so on. He was still
presumptively biased based on his actions.
The verdict of a jury must
be sacrosanct in order for our court system to function. That is why judges
must go to great lengths to preserve the sanctity of their juries.
