- "If only all patents were held to this standard"
- "Would be nice if all patents were held to this standard"
- "Would be good that all patents were held to this standard"

"Would that" is a grammatical form known as a subjunctive. It is not
commonly used in modern English; Wikipedia refers to it as an "archaic
form".
"I would love to see all patents held to ..." would be roughly the
same meaning, but doesn't quite have the same flavor; it's missing that desire
for a reality in converse of that which exists.
Anyway, no, it's not an error; just written by a person with a rather
