I'm betting we've got lots of Groklaw readers who are of a generation that would
recognize the subject line's reference.

(As an aside... it feels strange, replying to a Tiger99 post that has no
references to aggressive furniture arranging. Oops, I've said too much! =)

Warmest regards,

The Anonymous T... uh... nevermind, not applicable this time. I'm so
confused.

You have to pick your battles
Authored by: hardmath on Friday, December 14 2012 @ 09:32 AM EST

In this case Apple was inviting Judge Koh to make rulings that weren't raised by the jury findings, and that would have had the effect, if she chose to make such rulings, of locking in the jury findings (by parsing through them, making further factual determinations to support the "defenses" to infringement that the jury didn't find Apple to have committed).

Yes, it is a mess those jury findings. And I suppose the fear of making a ruling that would compound the mess is a real possibility. But you have to pick your battles, and I can see the wisdom here of not following Apple's wishes.

Authored by: Anonymous on Friday, December 14 2012 @ 12:57 PM EST
My grandpa called someone who sits on a fence a mugwump. With their mug on one
side and their wump on the other.
