HTC did not realise how week the Apple patents were – and they wanted to get on
with the job of selling phones.

settlement motives

A lot of companies look at settlements as a form of
insurance. The settlement costs have to be weighed against
the risk of losing and the cost of both preparing for a
lawsuit as well as fighting one. More valuable than the
settlement fiscal transactions could be the publicity of
having someone like HTC agree to a settlement. Apple could
reap a huge FUD value of having HTC agree to a settlement,
even if the 'royalties' paid to Apple were just pennies per
phone. Just look at how much attention MS has gotten with
their deals. In fact, my bet is that Apple settled for an
amount that they would never have considered, had the
Samsung case not turned into a PR footgun... Apple may well
have settled for what will end up to be less money changing
hands than HTC would have been paying in attorney costs just
to prepare for a lawsuit.

But if the reason was not money but to help
justify the software patent litigation game then
there may some 'splaining to do.
