A patent is supposed to be applied to a very specific implementation of the mousetrap.

Someone comes along, reads your patent, designs a better mousetrap that does not practice your specific invention but practices a new design.

This is what P.J. was describing and does not have to wait for the 20 year period.

If they wish to build your mousetrap design - then yes, they'll have to either wait or pay licensing.

And therein lies part of the problem: the belief of some patent owners to totally prevent competition whether or not your particular mousetrap design infringes their mousetrap design.
