Just to clarfiy my above post, I think the placing of the comma is critical in
reading this..
As it was originally, ie we all
knew..
We have not identified any attorney or other member of
the litigation teams who was aware that Mr. Hogan had been a party to lawsuits
involving Seagate until after the conclusion of trial, when Samsung raised the
matter in connection with its post-trial motions.
As it should be

How about people outside the litigation team ?
For example an outside investigator that knew it and some attorney outside the
litigation team who was aware of the facts but decided to not tell the attorneys
in the litigation teams so the team had deniability.
That way they could use it if the trial didn't go their way.
