Note damage to Apple's credibility, however...

Apple's credibility in the courts is one thing. It's falling
fast, particularly after the shenanigans they've been
pulling lately.

Their credibility with consumers is something totally
different. Though Apple may well be losing the court battle,
they have not lost the hearts of their loyal fans. And with
the Windows 8 debacle, they stand to pick up quite a few new
fans.

Of course, neither Apple nor Microsoft have ever had much
credibility in the open source community. The last time I
remember Apple being really helpful was when they gave back
to the community in the form of improvements to WebKit.
