Court Fight Over Madoff Suicide
Authored by: Anonymous on Wednesday, November 14 2012 @ 11:07 PM EST
Mr. Madoff killed himself in 2010, two years after his father, Bernard, confessed to a massive Ponzi scheme.

Lawyers for Stephanie Mack—formerly Stephanie Madoff—claim the trustee can't seize her prenuptial-agreement proceeds or properties in Manhattan and Nantucket that she jointly owned with her husband.

The trustee is waging a battle with family members over money they allegedly got through the fraud.

Have earwax? Leave it alone.

How's this for off-topic.
Have earwax? Leave it alone.

Is this off-topic enough :)

FYI, I had a blocked ear canal for two weeks, with the most excruciating earaches. My doctor told me to keep Q-tips out of my ears, and the problem hasn't come back.

Andoid now at 72% of smartphone market
Authored by: SpaceLifeForm on Wednesday, November 14 2012 @ 11:49 PM EST
It therefore should be no surprise that
Apple and Microsoft are attacking Android.
Their survival is at stake.

It seems though that instead of spending money
on litigation, they maybe could spend that money
on developing better cost effective products
that would have a chance to compete in the market.

Except that is a trait apparently not in their
genetic makeup.

Sinofsky’d

Some interesting links from the article...

1. BBC not bringing iPlayer or live streaming to Windows Phone, blames Microsoft

2. Microsoft’s tablet moves make Nokia look cunning Management incompetence and the Zuning of tablets

3. HP said to dump Microsoft over Surface WART is no longer welcome at most OEMs

4. Consent decree over, Microsoft goes back to monopoly forced bundling That didn't take long now did it?

5. Valve puts apps on Steam, Microsoft still lacks a Windows 8 strategy Opinion: Microsoft management still doesn't get their own market

6. Blizzard Isn’t Happy With Windows 8 Either

7. Microsoft brings not-Metro touch UI to servers to stop the bleeding IDF 2012: Dumbest idea of the year

8. Microsoft Surface can not compete against real tablet In pictures: Designed to be a failure

First time that I have given serious consideration to the idea that MS's core business could be threatened.

We are living in interesting times...

Southern Europe burning
Authored by: Anonymous on Thursday, November 15 2012 @ 11:53 AM EST
Things are heating up in the southern areas of the EU.
Massive wide-spread protests against the neo-liberal
austerity-for-people-money-for-the-banks regime.
The Economist just compared France to a (financial) bomb waiting to blow in the
heart of Europe - veiled calls for the socialist French government to get with
the program and cut social spending.
How long will the average policeofficers, currently protecting the wealthy
elite, keep doing so, when they themselves or their families are squeezed in the
zero-growth, no-hope financial climate of the EU? And when they join the
protesters, then what? The armies of Europe sent in to restore order and keep
the peace...?
In the future, the current liberal agenda will be seen for what it is; a threat
to the modern, participatory societies of Europe, with the EU serving as the
vessel, on a par with the fascist and soviet communist attempts of the past.
Today southern Europe. Tomorrow the rest of the EU.

Viva la revolution!

US Voting Rights Act
Authored by: Anonymous on Thursday, November 15 2012 @ 01:28 PM EST
The (US) federal voting rights legislation is in 42 USC Chapter 20, available at
http://www.law.cornell.edu/uscode/text/42/chapter-20 . One of the most important
parts is Section 1973 (in Subchapter I-A), which prohibits voting practices or
procedures that gives members of an racial group "less opportunity than
other members of the electorate to participate in the political process and to
elect representatives of their choice." The DOJ gets lots of injunctions
against violations of Section 1973, including against violations that appear
neutral but have the effect of hurting minority voting power. There are also
criminal penalties for violation of Section 1973 in Section 1973j, but the DOJ
does not seem to use them. Reading Sections 1973 and 1973j literally it seems
that someone acting in good faith could be criminally liable under Section 1973,
which is absurd. I wonder if some court struck Section 1973j down for that
reason and that is why the DOJ doesn't use it. Does anyone know an explanation
for the DOJ not pursuing criminal sanctions under Section 1973j?

According to the Groklaw comments policy "divisive topics are not
appropriate here." The political consequences of voting rights make voting
rights potentially prohibited by the divisiveness rule. On the other hand IIRC a
court judgment against a recent voting rights violator appeared in the news
picks recently, so maybe discussion of specific voting rights incidents are OK
as long as discussion is exclusively on the violations, not extraneous political
discussion.

Making old code GPL
Authored by: IMANAL_TOO on Thursday, November 15 2012 @ 04:51 PM EST
A small (11 staff) company called Frictional Games who produce horror games (no, I don't dare playing them... :| ) has released the source code of their successful game 'Penumbra Overture', available for Windows, Mac and Linux.

It is the complete game. With all code GPL3!
/* * Copyright (C) 2006-2010 - Frictional Games

* This file is part of Penumbra Overture.

*/
The rationale? The developers said:
"We have been talking about releasing the engine and game code as open source for quite some time. With the success of the Humble Indie Bundle came the perfect opportunity and we decided to join the other games in releasing our code. Although the code for the game and engine encompass several years of work, it is not actively used today. It was basically just rotting away in the dark corners of our hard drives. It feels much better to have it published in the open, where it has a chance to grow and do some good. I hope that it will be found useful and I am excited to see what people can do with it!"
How often does this happen? Developers releasing former proprietary but unused code under GPL? I know IBM has done it with some 3D-engineering programs. But what else is there that is no longer sold and perhaps could end up GPL'd?
