I agree. Who knows if Google maybe stepped in on the side of HTC as a silent partner, lending them a key patent or two for the occasion? Also, the writer of the article says...

The HTC deal is bad news for Samsung, and even worse news for Google. Whatever royalty HTC agreed to, it sets a floor for any future deal between Apple and Samsung. ...in the end, Samsung won’t be able to get around the fact that this HTC deal happened, and its price tag will carry some weight. Samsung, sooner or later, will end up paying a similar price.

I don't see any logic in that at all. There is no reason given to justify that statement.

You raise good points, and may be right. But, on the other hand, it appears from
HTC's website that all there new phones are going to be windows phones, that
would be a logical result of huge royalties on any android phones. Really I
don't see any other reason HTC would make windows phones, it generally seems to
be a dead end operating system.

If HTC is as patent poor as the article suggests then, yes, I'd buy it. Not
because Apple has such strong cases, but precisely because they don't!

What HTC sees/hears is "See, look at our flailing Samsung cases, we don't
care how strong our case isn't, we're going thermonuclear, ok? Its not really
about patents, its about your survival. So how much are you willing to spend?
We can make a deal..."
