The judge that has been ruling in Microsoft's favor all along in this case is
the District Judge from Maryland, Judge Motz.

The judges that denied this first request to file an overlength appeal were
judges of the 10th circuit court of appeals, judges Kelly and Gorsuch. This
circuit court has not made any rulings in this until Novell filed this appeal,
as the prior appeal was made in the 4th circuit, which is where the appeals are
heard for cases from the District Court for Maryland.

I suspect that Microsoft did not oppose the request because they would like to
file an overlength reply themselves and would like ammunition for their argument
in favor of that.
