But if she decides in agreement with Samsung on the issue, then there won't be
any appeal based on the lack of a response unless Apple tries to appeal on that
issue.
If the judge decides against Apple, could Apple appeal on the basis that Samsung

Actually, I think this decision is prejudicial against Apple, not Samsung.
Had the judge issue a ruling based on the briefs, then, yes, Samsung could be
said to have been prejudiced. Since there is an oral hearing, however, all
Samsung's lack of chance to respond in writing means is that Apple doesn't get
to hear what objections Samsung have to their opposition brief prior to the
actual hearing.
Samsung can still say what they want about Apple's brief. They just say it at
