My take is that the page is unbalanced. That is, I find myself subconsciously
pulling the scroll down to see the part of the page that is unbalanced as though
I am missing something. That is when I see the notification. I'm not sure how
direct the judgement needs to be without the judge holding the hand of the web
designer.

I don't know what the page used to look like but it seems Apple got the
message.

Apples that have been chewed on are still good for apple sauce.

The iPad ad resizing is a feature of all* worldwide apple pages of the form
www.apple.com/xy/ where xy is an ISO-3166 2-letter country code.
* = all countries where iPad Mini is being promoted. Some have
iPhone 5 featured, resizeable, some have iPod non-resizeable.

Now the immediate effect of the resizing is to force Apple's own
site navigation links below the fold, which emphasises the
minimalist look, and might send some readers scrolling..
But even without the resizing, the "normal" size of the home
page was about 1024px high. Putting the new notice below the
usual site navigation links makes it invisible without scrolling...

-Except- in the US www.apple.com does not have it resizeable
-and- the prominent bottom right icon is replaced with a
Superstorm Sandy Red Cross appeal. So they can make
things visible if they want.
