Maybe Samsung can go back to the UK court and ask for it to be ABOVE the fold?

It's the iPad Mini Ad
Authored by: Anonymous on Saturday, November 03 2012 @ 05:55 PM EDT
That came along after the first judgement requiring a notice,
but planning for it may have been more or less the same time.
The ad is designed to resize, presumably part of the slogan
"Every inch an iPad", but it does force Apple's own navigation
links below the window bottom border giving the page an
even more minimalist look. Of course, putting the Samsung
notice below the navigation links almost guarantees that it
would not be seen -even without the iPad ad- because the
"normal" page is sized to fit about 1024px vertical. I have not
measured it, or disasembled the style sheet. With the iPad
resizing in force a screen significantly higher than 1080px
is needed to see all the contents without scrolling.

Now if Apple is relying on viewers using NoScript that's another matter.

The mothership or US home page does -not- have an auto-resizing
iPad ad, -and- it does have a very visible Superstorm Sandy appeal
replacing one of the bottom row icons. Not at all knocking the appeal,
a very worthy cause, but, it shows they can make things visible,
if they want...
