Well, Apple asked the same question of Samsung, and claimed the timing of knowledge was relevant. Samsung's just going "What's sauce for the goose is sauce for the gander. If when parties knew about the issue is relevant then it's relevant to both parties, not just one.".

Either Apple knew, didn't tell the court, and is for the high jump; or
Apple didn't know, so Samsung couldn't have known, Apple should
just sit down and shutup.
