That seems to be a blind spot for a lot

Not just the US Gov... or the ??AA's of the world, but others as well.

Consider the German entity that actually considered taking a defence in Court that the GPL was invalid and it took the Judge to tell them the logic of that argument:

    Let's say you are right and the GPL is invalid, then I hope you have another license for the code or you've clearly admitted to be in breach of Copyright!
The case settled shortly after the Judge told them that.

But seriously: why did it take the Judge to point out something so obvious with their argument? That if the argument was correct, they'd harm themselves?

Lots in the proprietary world throughout the world don't seem to be able to think logically enough to recognize the risk to themselves.

But what happens if the court orders, let's say, BP to do something. The court
has no jurisdiction over the board, and if the board says "go ahead",
how can they hold a subsidiary responsible?

The thing with this issue is the court has jurisdiction over the Motorola board,
who have authority over the German subsidiary.
