I would venture to say that besides the great investment in
legal talent by M$, M$ invests heavily in professional
psychologists and other behaviour specialists.

They stupidly created a moderation system, which allows
the astroturfing trolls
to attempt to disrupt the comments.
It was real apparent with the recent
article titled
Samsung, like Google, now under DOJ
scrutiny over standards-based patents .

There is no doubt that Groklaw is at times a target for trolls on a mission and
these are normally flushed out by shining the bright light of facts on their
frail logic.
No problem there. However, there have been instances on Groklaw of people taking
a critical stand, voicing opinions not (completely) aligned with that of
Groklaw's general commenting corps, and the label 'troll' is perhaps, on
occasion, bantered about too lightly.
There is a danger of borderline maybe/maybe not trolling instances turning into
cries of wolf, and that could have unwanted consequences for the otherwise sober
and intelligent discussions generally carried out here.
One tentative solution could be a troll flusher team or arbitration panel that
could pen flagged postings, compare these to past postings or known troll
outlets and either ban or forgive, depending on the findings.
So far, PJ has successfully steered a steady course in keeping the site clean
and I am confident in her (and Webster's) ability to steer straight as we go
along. As is often repeated here: it is PJ's site & she may do as she
pleases. The above is therefore merely a suggestion to help maintain the
soberness of the Groklaw commentry.
