I have seen this argument before, but I must say it cannot be stated too often. It is such a practical position on the subject that it bypasses all other more abstract discussion, such legal definitions of software magically creating new machines or that software is math. Compare the lengths PoIR had to go through proving software is math to a simple, practical matter of trying to run a software patent system. It is something just about anybody can understand.
