But the Copyright Act of 1976 extended the renewal duration
to 47 years, after the initial 28 years of copyright
protection.

Then, the Sonny Bono Copyright Term Extension act of 1998
extended the renewal duration by 20 to 67 years for any
copyright protected media created before 1978, effectively
making it possible for that image of Einstein, whose
copyright is owned by the Hebrew University of Jerusalem,
for 95 years after its original copyright date.

2012 - 95 = 1917

For GM to be able to use that photograph of Einstein without
reproach, the photograph would need to have been taken
before 1917. I can't find any definitive information on the
copyright year of that image of Einstein, but I would expect
that given his apparent age it was taken after 1917.
