I don't disagree with what you said, but few arguments would be as important to
win as the ones about juror misconduct. If either side had effort to spend, they
would spend it here. If Samsung wins on any of their arguments (except for the
one about the judge looking into it more) and the appeals court agrees (it will
ultimately wind up there), the entire verdict will have to be thrown out. A heck
of a lot of wins and losses for Apple along the way will become moot. It won't
matter anymore that Samsung couldn't talk about "Sony Style" nor show
the jury pictures of the prototype phone that they were working on before the
iPhone came out. Samsung would presumably be able to tell the next jury about
them. Many other things would be reset, too.

This would also be a huge PR loss for Apple. Apple would spin it as a
technicality and say any other jury would decide the same way, but especially if
the next jury doesn't, it will seem as if Apple and their fans stack things in
Apple's favor because it's the only way that Apple can win.
