The current result of the UK Appeal is that all of Apple's wins in local
European courts on the design fight have been overturned and Samsung declared
non-infringing. Judge Birss was sitting as a pan-EU court not a local English
and Welsh one. Apple seem not to have noticed that important factor. The case
would have been referred to the Community court anyway. Now then does that open
the door for Samsung to sue for some serious damages in Europe? Apple as the
loser will already have to pay the legal fees. Anything a US court might be
persuaded to award Apple could become insignificant in the global context
