In the original judgment the UK judge was not sitting as a UK court but as a
Community court. That makes the judgement binding in Germany. The later German
court rulings are therefore void. From the Appeal Court Ruling:-
"Sir Robin Jacob.......Judge Birss was sitting as a Community design court…
So his declaration of non-infringement was binding throughout the Community. It
was not for a national court… to interfere with this Community wide jurisdiction
and declaration," he said in the ruling."

capable of making
