What gets me is that the visual differences between the iPhone and the Droid
phones I saw was in-your-face obvious, until the iPhone 5 came out. Who seems
to have copied who?

A pad / tablet is really best described as a

display device.
That is what it does with a couple of bells and whistles other display devices
don't have.
Think about what it is used for:-
Display movies; display pictures; display images; display text (books etc);
display maps etc
It is just another display device in a long line of simpler display devices
such
as TV set; picture frame (both digital and the old fashioned hang on the wall
or sit on desk types) computer monitor
Black / white board; piece of paper (singular or book including atlas or
street directory)
Of all the material displayed on the preceeding devices somewhere north of
99.99% is in a rectangular format. So if your new device is going to be of
any use it needs to be rectangular or at least have a rectangular display
area.
So rectangular is functional. Period! It is therefore not patentable!!
