I am a software engineer.
Based on the first post, it came down to Algorithm's (computation of symbols
etc).
Lets say software is math for a second.
If a competitor was to reproduce the exact same software (with respect to
features) however implemented it differently (different algorithm, different
computation, thus different math), at the end of the day you would have 2
different products while one is really ripping off the idea/concept of another
software.
