The point is though, data that comprises software cannot have its origins purely
as a result of manipulations in machine state. A person needs to reflect on
environmental parameters and examine them in ways that go beyond the computer
system and then make efforts to incorporate those parameters into the existing
model. When those solutions start solving problems in a useful way it
misleading to say that "computer data" is responsible for those
solutions because the genesis of the solution resides in data was a very
intentional effort by someone who spent time and money.
The question then becomes whether the machine characteristics he introduces can
be viewed as something new conforming to some agreed upon criteria that is
