The main problems with the 2003 extradition deal - from a British public view of
things.

The lack of any check on the standard of evidence before extradition.

The threat of excessively long sentences being used to pressure an innocent to
plea bargain.

The huge disparity between the length of sentence in the US and the UK for the
same offence.

Apparent vindictiveness and perceived lack of mercy in the US justice system.

The huge power of the US being used against a private citizen of the UK.

Trying to get a fair hearing in a foreign court while cut off from the support
of family and friends.

The horrendously brutal reputation of the prisons in the US.

Wasn't Ed Gibson hired by M$ on a large salary as a reward for creating this
extradition request to drawing attention away from M$'s poor security features.

UK politicians over-rule M$'s commercial wishes?

Also take note of the context of when this affair about Gary fist arose in 2002
when Microsoft insecurities were becoming big news and was coming under pressure
from other operating systems.
Back in 2002, Jim Allchin was co-president of Microsoft's Platforms and Services
Division and was, in his own words, "scared" of the momentum behind
Linux, as noted in an email [PDF] sent to several of his direct reports.

Gary was, when originaly interveiwed, told that further action action would be
taken - then insteeped Ed. Who then offered a plumb job at M$. What a
supprising coinsidence.

own nationals.

US authorities have described Mr McKinnon's actions as the "biggest military computer hack of all time" and have demanded he face justice in America.

They insisted his hacking was "intentional and calculated to influence and affect the US government by intimidation and coercion".

Does the US realize how incredibly weak this statement makes them appear? They can't secure their networks from some bored misfit looking for UFOs? Wow - no wonder China is walking all over them if they are that impotent to defend themselves. If I was responsible for the security in this situation I wouldn't want to admit I was taken down by this guy. Here they are saying this guy has not only defeated them, but that they are intimidated by him! Wow, intimidated by some lonely guy with Aspergers.

Likely a large percentage of people that
read Groklaw also have Asperger's syndrome.

What Damage Did McKinnon Cause?

We keep hearing of these hundreds of thousands of dollars damage,
sorry this has probably been argued ad nauseam over ten years.
I can imagine that would be a ballpark figure for properly locking
down systems that big and that complex. I don't buy the argument
that because they did the work post-McKinnon it was caused by him.
Only a US judge would believe that. Then of course the poor guy is
caught Catch-22, he would have to go before that US judge to offer
his defense that the systems were wide open, and the Mils should
have spent the money before he came, and all this would never
have happened. And any evidence useful for such a defense will
be long gone...
