It is not really possible to draft Standards without patent encumbrances. There
is always the possibility that someone somewhere not involved in the process has
a patent on something included in the Standard.
One of the reasons the RAND developed is to encourage patent holders to get
involved in the process because they could monetize their inventions at a low
rate but get massive adoption.
The alternative is some bad actors, including major companies could refrain from
participation in the process in order to withhold their inventions from the
Standards, maximize their market position and licensing revenue.
