This all basically boils down to what you want prisons to be:

Do you want them to be a punishment for deeds done. ie: Revenge committed by
the state? Then bring back the thumbscrews and iron maidens.

Or do you want them to be rehabilitation, where the offender is retrained to be
a useful member of society? Then get rid of sentence terms, and change them all
to "When he's ready". And turn them into schools.

Prisons can't be both of these, as they have opposite requirements on the
treatment of the prisoners.


And while you're thinking about this: Revenge doesn't work. To give an extreme
example: You kill me. My brothers kill you in revenge. Your brothers kill my
brothers in revenge. My cousins kill your brothers... And on and on and on.
