Are their real problems with FRAND? Of course - since they seem to allow
discrimination against GPL-like license terms. We all have our own particular
likes/dislikes (problems or not) with any agreement.
But Apple does have
one point which they should apply to themselves as well:
"The
average selling price [ASP] approach wrongly permits the patent holder to
collect value unassociated with its contribution to the standard," Apple chief
intellectual property counsel BJ Watrous argued in a morning
session.
Ahh... words to live by:
collect value unassociated
with its contribution
And Apple wanted how much for "rectangle with rounded
corners"?

Have you ever seen a teenage who has a "real" problem, but
manages to reject every solution you offer with a sentence
of the form "yes, but <explain why a solution can't work>."
If somebody is serious about solving a problem then he
should try at least some of the offers. I'd respect the
objections to FRAND had the objector made a real effort to
use the existing mechanisms before running to a judge.
