SCO v. Novell is done
Authored by: egan on Thursday, October 04 2012 @ 06:30 PM EDT

Boies Schiller no longer has a conflict of interest with respect to the SCO v. Novell lawsuit because that has ended in a loss for SCO with finality, as the appeal was denied.

It's still on the hook for the SCO v. IBM lawsuit, but that doesn't present a conflict of interest for its represention of Novell.

There's also a fair chance that SCO v. IBM will be dismissed if SCO is dissolved in Ch. 7 liquidation before trial, which is looking increasingly likely. All Boies Schiller will have to do at that point, I would think, will be to inform the US District Court in Utah that a trial would be moot because its client no longer exists.

Novell is over. The IBM case may get
resurrected someday, but Novell is totally
over.
