I wouldn't exactly put too much weight in the Court's
analysis. The Court said the exact opposite about Novell's
theory in 2010, when he ruled in a detailed opinion that
Novell survived summary judgment. While there is no
guarantee, the Court's ruling could get overturned on appeal
by the 10th Circuit. Reasonable minds can differ. For one,
the Court's recent decision to dismiss the case, and its
statements regarding middleware, appear to directly
contradict the D.C. Circuit's opinion in U.S. v. Microsoft
regarding middleware and when software presents a potential
threat to the Operating Systems market. David Boies, who
tried U.S. v. Microsoft to a successful verdict, will argue
that Judge Motz was wrong in his analysis. Its kind of
stupid to argue online about who might win or lose, we'll
