From that transcript, though, I have to give Mr Hogan the benefit of the doubt.
The Judge screwed up.
Either her first question to him should have been "how many lawsuits?"
or she should have followed up with "and any others?".
Reading the transcript, it seems he mentioned the first lawsuit, she questioned
him about *that* lawsuit, and then *she* moved on. Others have picked up on
that, too. Worded differently, when (as per the transcript) was he given the
*opportunity* to mention other lawsuits? I can't see it.
Cheers,

Hogan's first answer should have been one word: yes. [ Reply to This | Parent | # ]

I suspect that before voir dire Mr Hogan had persuaded himself that anything
more than ten years ago would not be relevant to the judge and parties. When
asked about any lawsuits ever, he projected his internal voice saying 10 years
into the question asked. A month or more later he 'remembers' what he expected
to be asked, not what was actually asked. He was apparently good at leading the
rest of the jury towards a false conclusion and is probably equally as good at
doing so to himself.
