Misconduct on the part of a Juror can't be blamed on the Judge.
She had no way of knowing that the Juror was doing wrong things.
You can't filter out Jurors before they get into the room, the Jury selection
process is the process designed to do this filtering. The Jurors are under oath
when answering. The Judge and Lawyers also want to see the Juror answer the
questions to try and catch hints that they may not be truthful.[ Reply to This | Parent | # ]

Didn't Samsung just ask that?
It was barely in passing, but they are raising it.
"To date, Apple has not revealed whether it was aware of Mr. Hogan’s
