Furthermore, and this is based on Hogan's accounts to the press... I have to
wonder how much, exactly, did Hogan influence the jury? Was he even being
honest with the press?
My impression is that there is only one way to find out, and that is by
re-trying the case in front of an untainted jury.
But, IANAL and all that, so I'm wondering what the rules are (if any exist) for
determining the extent of damage to the fairness of the courtroom, and then what
the rules are (if any exist) for re-trying the case.
If the court determines that Hogan did in fact poison the jury, what are his
responsibilities at that point? Does he pay the court fees? Is there a fine
involved? Jail time? Or is it the decision of the court to make at it's own
discretion?
