The issue seems to be that as MS and Motorola/Google are both US companies, a US
judge could conceivably demand that Motorola order its German subsidiary to
abandon all rights and claims it may have under German law--potentially,
includining Motorola Inc to instruct Motorola GmbH (or equivalent Google bodies)
to explicitly request its claims be dismissed.
So far, though, the US court hasn't explicitly ordered Motorola to withdraw its
German claims--instead it is purporting to enjoin the German court's ruling.
Now whether the German court does so--is another question. What if the German
court were to refuse, and continued to ban import of the Xbox? Has the German
court responded in any way to the US rulings, and/or Motorola GmbH withdrawn any
