The problem is that when they try to define the
term "non-discriminatory", they need to exclude
free software from the equation, because anything
that is given away for free cannot have a license
fee that is calculated per copy.

Actually writing "fair to all except free software"
and "discriminatory only against those hippe
freeloaders in the GNU community who make our
aging business model obsolete" would not go down
well in today's political climate where free
software is pervasive and attracts ever more
attention from governments, businesses and
end users. The patent lobby must keep the terms
RAND and FRAND undefined, or they will evaporate.
