A) When was he asked to list them all? The whole panel was
asked to if they had any examples. When the judge when to
Hogan he gave details of his first. Judge Koh never asked
if that was all, never asked if he had more. At least not
in the transcript excerpt I've read provided from Samsung's
motion.
To me the important point here is that Judge Koh did not ask
for more information. She moved on to the next prospective
juror to soon.
B) You say that Hogan failed to live up to his promise
(which I agree with) and then mention human nature but
ignore it's full implications.
If the jury system punishes someone who claims to be able to
be a good juror but can't then who will do the job but the
incompetent? A wise man will admit to his fallibilities.
Hogan probably should have said "I will try to" or "I'll do
my best" rather than making an absolute claim, but that is
human nature for the over confident. His actions (in
seeking media attention) post verdict do suggest that he is
confident in what he did even when others say that he was
wrong. I've been guilty of that myself - and sometimes I've
been wrong.
To me both your points are things that we have to accept
happend from time to time in a layman jury system.
