But if they don't raise it here, they will not be able to
raise it on appeal.

I agree that is very difficult to get a judge to admit that
they conducted a bad trial. I hope all of this stuff is
appeal-able to another court.

IIRC she repeatedly warned both parties to settle or face
unpleasantness.

I think she may have anticipated a less one sided result
with both sides paying a heavy price for wasting her time on
something that could have been settled before trial.

I think she may be wondering what can be done at this point
to correct things, and this motion gives her a *lot* of
options.
