Koh asked jurors,
"Have you or a family
member or someone very close to you ever been involved in a lawsuit, either as a
plaintiff, a defendant or as a witness?"
He was not specifically
instructed to breathe either. What part of "ever been involved" does he not
understand?
Koh's was a yes/no question. I believe Hogan answered
"Yes", which was true. When asked for more information, he described one case,
in a true-enough manner.
It seems like a weasel answer, or the kind I might
expect from a computer, but nobody got in his face and demanded to know if there
were other cases. Maybe he was about to describe other cases when the
questioning moved to other subjects.
He answered the question asked, and no
other.
This might be a virtue in a witness under cross examination, but it
might be misconduct in a potential juror—I don't
know.
